LinkDIGS, Inc., (we, us, our) provide the LinkDIGS app and LinkDIGS website (the Service) to users (you, whether you are an individual or a company). The service makes use of a structured set of data, text, and media files that include information about properties (the Dataset).
By downloading and using the app, or accessing the Service, you signify that you have read and agree to these terms. You represent that you’re either a real person who is at least 18 years old; or you are a business entity, and the individual agreeing to these terms has the authority to bind the entity.
Restricted use.
You may use the Service only for your personal use, and your commercial use is limited to transactions done on your own behalf, unless you are a real estate or lending professional. The commercial use of real estate and lending professionals is limited to providing information to consumers via the Service or, where authorized, taking actions on behalf of a consumer client (for example, posting a home for sale). Lending professionals and institutions are prohibited from using information provided by LinkDIGS through the Service in making any loan-related decisions. The Services may be used only for transactions in residential real estate and may not be used for transactions in commercial real estate, which includes, without limitation, commercially zoned properties, timeshares, and vacation rentals.

LinkDIGS grants to you a worldwide, non-exclusive, royalty-free, revocable license to download its App to a mobile device and to use the App. You may copy and store the App and the material available in it in your browser cache memory, and you may copy information from the Service as necessary for your personal use to view, save, print, or e-mail it.
You agree that you will not adapt, modify, transform, publish, republish, distribute, redistribute, decompile, reverse engineer, or provide access to any part of the Service without our prior written consent. You agree not to use any automated data collection methods on the Service, including data scraping, spiders, or robots, unless we have expressly given you permission.
Ownership of Intellectual Property and Limited License
All intellectual property to related to the Service, including all the information in the Dataset, is proprietary to us. It is protected by copyright, trademark, or patent laws, and is owned exclusively by LinkDIGS. You agree to respectfully use our intellectual property, which includes, but is not limited to, computer or software code, scripts, design elements, graphics, interactive features, artwork, text communication, and any other content that may be compiled or provided by the Service. All trademarks, service marks and trade names are owned, registered and/or licensed by LinkDIGS. You agree not to remove or modify any copyright or other intellectual property notices that appear in the Services. You will not use the Services for resale, service bureau, time-sharing or other similar purposes. You agree not to use the Service in any way that is unlawful, or that harms LinkDIGS, its service providers, suppliers or any other user.
Images and your contributions to LinkDIGS
If you create or modify any content on the Service, you agree to: provide accurate and current information, and to be fully responsible for all use of your account and for any actions that take place using your account.
Users may upload images of residential property, which are then included in the Dataset. By contributing or posting any content on the Service (including making updates to existing content in our Dataset or adding new content to the Dataset)(your content), you grant LinkDIGS, Inc. and our assigns, agents, and licensees the non-exclusive, irrevocable, royalty free, perpetual, worldwide license, with the right to sublicense through multiple tiers of sub-licensees, to use, reproduce, modify, display, and distribute your content in any medium and through any form of technology whether now in existence or which comes into existence in the future. You should not upload any content in which you do not have sufficient rights to grant this license to us.
No images of children under the age of 18 are allowed. If you are in the picture, you agree to release all rights to your image to be used by LinkDIGS and/or assigns or any affiliate or acquirer of LinkDIGS for any purpose whatsoever in any medium. LinkDIGS may remove any photographs including people at its discretion.
Our Dataset benefits from content, including media files, submitted by anonymous users, registered users, partners, and our staff. This information may be inaccurate and/or out-of-date. LinkDIGS assumes no responsibility regarding the accuracy of the information in the Service. Use of such information is at your own risk.
IP Address, Locations
When you access the Service, some information may be automatically collected, such as your computer’s Internet Protocol (IP) address, your computer’s operating system, the browser type, the address of a referring web site, and the time and date of your visit. When you access the Service using your mobile phone, you may allow the Service to acquire your location coordinates in real-time. We do not acquire your coordinates unless you have authorized our Service to do so. We may use this information to offer you services, or to protect, enhance or update the Service.
Limitation on liability
The Service uses the most up-to-date technology and standards comparable to websites of our size to ensure quality, availability, security and reliability – however, as with any other software application, events which may cause disruption to our services are always possible due to issues with our software, unforeseen events such as accidents, or intentional interference. Neither LinkDIGS, Inc., nor any of its employees, directors, officers, agents, contractors, service providers, partners, subsidiaries, affiliates or joint ventures will be liable to any claims or damages arising out of or related to your use of the Service, including consequential, lost profits, special, indirect, incidental, or punitive damages.
Disclaimer
The service is provided on an “as is” basis “with all faults” and without warranty of any kind, express, implied, or statutory. To the full extent permitted by law, LinkDIGS Inc., disclaims all warranties related to your use of the Service. This disclaimer also extends to any of our employees, directors, officers, agents, contractors, service providers, partners, subsidiaries, affiliates, joint ventures, and any other party involved in creating, producing, or delivering the Service. Specifically, we do not warrant that the information in the app is complete or accurate. You agree not to rely on the Service to make investment decisions.
Indemnity
You agree to indemnify and hold harmless LinkDIGS, Inc. and its employees, directors, officers, agents, contractors, service providers, partners, subsidiaries, affiliates and joint ventures, from any loss, liability, claim or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Service.
DCMA Claims
If you believe that your work has been reproduced in connection with the Services in a manner that constitutes copyright infringement, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Copyright Agent with the following information in writing: (i) a physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest, (ii) identification of the copyrighted work claimed to have been infringed, (iii) a description of where the material that you claim is infringing is located within the Services, (iv) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address, (v) a signed statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law, and (vi) a signed statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or you are authorized to act on behalf of the owner. General
These Terms of Service will be governed by the laws of the State of Washington, without reference to its rules regarding conflicts of law. Any claim or dispute between you and LinkDIGS that arises in whole or in part from the Services, Terms or any relationship between us, shall be decided exclusively by a court of competent jurisdiction located in King County, Washington. You further irrevocably agree to submit to the personal jurisdiction of the courts located within King County, Washington for the purpose of resolving all such claims or disputes.
We reserve the right, at any time, to update or modify these Terms of Service simply by posting the change without any other notice to you. Any such change will be effective immediately upon posting. It is your responsibility to review these Terms of Service from time to time to ensure that you continue to agree with all of its terms.Your continued use of the Service means that you assent to any new terms.
If any provision of the Agreement is held to be invalid or unenforceable, it will not affect the enforceability of the remaining provisions. Headings are for reference only and in no way define this agreement. Our failure to act on a breach by you or any third party does not waive our right to act in accordance with this agreement. This is the entire agreement.
